hate crimeとは？

何気なく記事のヘッドラインを眺めていたのですが、今日はやたらと"hate crime"という表現が目につきました。

"hate"も"crime"も基本的な単語なので、そのまま頭で和訳すると、”憎しみ”による”犯罪”、と解釈できるのですが、いまいちしっくりときません。

試みに1つの記事にアクセスして読んでみたのですがちょっと混乱してしまいました。

Authorities say a young Pakistani woman was killed and her husband was wounded when they were gunned down as they walked along a quiet neighborhood street with their 3-year-old son in northern New Jersey.

The Morris County prosecutor's office has said a preliminary investigation suggests the shooting was not random. A law enforcement source tells NBC New York that it is not being considered a hate crime.

"From what we have already determined ... it should be noted that this shooting clearly appears to be target specific and that there is not a continuing danger to the general public at large," said Morris County Prosecutor Robert Bianchi.

アメリカでパキスタン人が銃で撃たれたという事件についてなのですが、警察当局の調べでは事件は"hate crime"ではなく、"target specific"だということなのですが、ここで混乱したのです。

つまり、憎しみによる犯行ではなくて、ターゲット（被害者）を狙ったものだ、ということですが、日本で殺人事件などがあると怨恨の線があるとかないとか言われますが、怨恨があるということが被害者と結び付ける訳で、記事の説明が矛盾しているように思えたからです。

つまり日本での報道ならば、怨恨（ターゲットが特定されている）か無差別（ターゲットは特定されていない）か、のどちらかという先入観があったため、この記事の内容に混乱したわけです。

しかしながら、いくつか他の記事も拾い読みをしていて、"hate crime"に特別な意味があることが何となくわかってきました。例えば以下の記事です。

SAN FRANCISCO—The overall number of hate crimes in California remained steady last year, but the number targeting Hispanics jumped significantly.

A state Department of Justice report released Thursday said there were 1,107 reported crimes motivated by race, religion, sexual orientation and other forms of bias in 2010. That's just seven more cases than in 2009.

While hate crimes against Jews, blacks and the LGBT community decreased, the state said hate crimes against Hispanics increased by 47 percent. Officials recorded 119 anti-Hispanic crimes in 2010, compared with 81 in the previous year.

上記を読んでいただければもうお分かりいただけると思いますが、"hate crime"とは人種や宗教などの違いからくる憎しみから行われる犯罪行為のことを指しているのです。

従って、憎しみ＝怨恨、ではありますが、それはアメリカ社会という多人種、多宗教の国における特別な憎しみであって、日本人には直感的に理解しにくいものかも知れません。（国際感覚豊かな方はすぐにお分かりいただけると思いますが・・・。）

日本と言うのは平和な国だなあと改めて思わずにいられません。
