日産が、国外逃亡したカルロス・ゴーン元会長に9,000万ドルの賠償を求めて提訴したというニュース記事が目に留まりました。


Nissan Motors filed a lawsuit in Japan on Wednesday seeking $90 million from its former chairman Carlos Ghosn, who fled the country before his trial on charges of financial wrongdoing.

The automaker says 10 billion yen, or $90 million, would cover the monetary damages it says Mr. Ghosn inflicted on the company through misconduct and fraud.

Nissan said it expected that amount to increase as it sought to recover the fines paid to the Japanese Financial Services Agency and other penalties linked to Mr. Ghosn’s alleged misconduct.

Mr. Ghosn has denied any wrongdoing. In an emailed statement, a spokesman said, “Nissan’s maneuvers continue,” noting that the lawsuit was made public one day before the automaker was scheduled to release its earnings report.

“Mr. Ghosn’s lawyers will react on the merits of the case once the content of the claim has been brought to their attention,” the statement read.

賠償請求の内訳は、ゴーン氏の不正によって同社が被った損害、支払った罰金などから構成されるようです。

ゴーン氏は恐らく反論し、請求を退けるでしょうが、国外逃亡してしまった相手に対して、日本企業が起こした訴追がどこまで効果があるのか、興味深いところです。

ところで、今日取り上げる表現ですが、記事の後段に、


Mr. Ghosn’s lawyers will react on the merits of the case


という部分があります。

日産による提訴を受けて、ゴーン氏側が発出した声明からの引用となっていますが、ここで使われている"merit"の意味がよく分かりませんでした。

メリット（merit）には利点とか長所、また賞賛や報償に値するもの、報酬、といった意味がありますが、ここではそれらの意味が当てはまりません。

従い、辞書を引くことになるのですが、ここでの"merit(s)"というのは法律用語で、


（訴訟において、手続き･技術的問題･個人感情の混じらない）実体上の事項；本案、事柄本来の理非、曲直
（ランダムハウス英和辞書）


という説明が載っています。

理非、にしても、曲直、にしても、普段使わない言葉かと思います。（広辞苑を引きましたよ。）

平たく言えば、正しいことと正しくないこと、ということになるんですが、日本語においてすら概念がよく分かっていないものを、英語で正しく理解するというのは、さらにハードルが高いというものです。

ネット検索で、法律のコンテクストにおける"merit"の意味するところを調べてみました。

ぼんやりと分かってきたことは、今回のケースで言えば、訴えられている事案（the case）について、純粋にその内容の正、不正、あるいは良し悪し、に目を向ける、というのが"on the merits of the case"の意味するところ、ということのようです。

これに対して、恐らくは訴訟上の手続きや形式的側面（？）を云々するという場合は"on the merits"ではない、ということなのだと思われますが、うまく説明するだけの法律知識を持ち合わせておらず、理解するにしてもこの辺りが限界と告白します。
