Memorundum of Understanding

アメリカとイランが戦闘終結でようやく合意に至ったと報じられました。

今朝の報道によれば、両国首脳が覚書に署名したということです。この「覚書」ですが、英語では、

Memorandum of Understanding 

と呼ばれ、MOUと略されます。

当初非公開であったこの覚書の14項目の合意事項は公開され、CNNの記事で全文を読むことができます。

The United States on Wednesday released the official text of the memorandum of understanding reached over the weekend with Iran.

A senior US administration official read out the 14-point document, which spells out provisions for reopening the Strait of Hormuz, easing certain financial restrictions on Iran and sets out expectations for addressing Iran’s nuclear program during future technical talks.

Titled the “Islamabad Memorandum of Understanding between the United States of America and the Islamic Republic of Iran,” the document was released after outcry that its text hadn’t been released publicly.

両国が戦闘行為を直ちに止めること、ホルムズ海峡の開放、イランの核開発の凍結などが合意されたということになっています。

しかしながら、この「覚書」を意味する"Memorandum of Understanding"の"memorundum"は法律用語で、

A short document outlining the terms of an agreement, especially as a draft leading to a formal, detailed contract: a memorandum of understanding.

と定義されており、正式、公式の契約合意に先立つ「ドラフト」（案）という意味合いがあるようです。

実際、覚書の第13項目では下記のようにあり、

13 — After signing this MOU, and subject to the beginning of the implementation of paragraphs 1, 4, 5, 10 and 11 of this MOU, and the continuing implementation of these measures, the United States of America and the Islamic Republic of Iran will start negotiations regarding the final deal exclusively on the other paragraphs.

この覚書の内容に沿って両国が最終的な交渉をスタートするというもので、まだまだ先は長いことを予測させる内容になっています。

一歩前進と言えば前進ですが、アメリカもまだ軍事攻撃の可能性に言及しており、イラン側もホルムズ海峡を通過する船舶への課金を諦めていない節があるようですから、覚書の合意など反故にされる前提なのではと思わされます。
