double jeopardy

2024年12月に保険会社のCEOを射殺した被告の裁判が報じられています。この事件は医療保険制度に対する不満を背景に大手保険会社の経営トップへの恨みを募らせて、株主との会合が行われるニューヨーク・マンハッタンの中心部で白昼に凶行に及んだというものですが、世間では26歳(当時)と若く、大学の修士卒という犯人に対する同情の声もあがり、アメリカの医療保険制度の歪みに対する議論を呼ぶなど、メディアによる報道も過熱しました。

被告は当初、無罪を主張していましたが、この週末の公判では殺害に至る背景と当日の行動を詳述し始め、一転して有罪を認めたということです。

この変化にはどういう背景があったのか?

CNNの記事によれば、被告は殺人を含む複数の罪に問われているようですが、ニューヨーク州と連邦の各裁判所の両方で訴追されており、弁護チームは"double jeopardy"を主張しているとあります。


More than a year after the fatal shooting of UnitedHealthcare CEO Brian Thompson, 28-year-old Luigi Mangione confessed to the killing in his own words as he pleaded guilty to federal charges in court Friday – a move that raises questions about the future of his upcoming state murder trial.

Whether it does remains to be seen, but legal experts said Mangione’s defense has a strong argument that could see most of the state charges dismissed under New York state’s double jeopardy law, which goes further than the US Constitution in prohibiting two prosecutions based on the same criminal act or conduct.

この"double jeopardy"というキーワードですが、同名の映画のタイトルを思い出す方もいるかもしれません。"double jeopardy"とは被告が同一の罪により2度訴追されることを言ったもので、合衆国憲法修正第5条(被告の黙秘権を認めるものとしてよく知られているものです)、及びニューヨーク州法は訴追されている被告に対して"double jeopardy"から免れる、すなわち同一の罪により2度訴追されないことを保証しています。

"jeopardy"という単語ですが、危険に晒されている状態、という意味です。フランス語jeu parti(フランス語jeuは英語で"game"、partiは"divided")から来ていると辞書にあり、勝つか負けるか、成功するか失敗するか、帰結が五分、つまり不透明、すなわち危険、ということになります。

search and seizure

このところ議論が喧しいFlock Cameraに関するニュースを今日も見ました。

Flock Cameraはプライバシーを侵害するものだという訴えがされているものですが、不適切な事例というのが次々と明るみになっています。記事によれば、Flock Cameraを使って交際相手の行動把握をしていたという警官が逮捕されるに至った事件があったそうです。

こういう事例が明るみになればなるほど、カメラへの破壊行為というのもエスカレートしているようです。Flock Cameraの利用制限の法制化の動きも出ているとあります。


Southold now has 11 Flock Safety cameras throughout the town. The tech, criticized as “Big Brother”-style mass surveillance systems for the local government, have been installed throughout Greenport, East Marion, Mattituck and Peconic, with the first four Flock cameras deployed in late 2022 while seven more were added last year.

Politicians on both sides of the aisle have introduced legislation in an attempt to cap Flock’s reach and strengthen constitutional unreasonable “search and seizure” protections.

State lawmakers are considering a bill that would restrict how government agencies can use and share the license plate data acquired through the cameras.

その法制化の中身としては、カメラが取得する情報の利用制限を如何に行うか、ということが焦点となっています。

記事中の、


search and seizure


とは、訳すならば捜査と差押え、となるかと思います。アメリカ合衆国憲法においては、何人も不当な捜査を受けたり差押えの処分を受けることが無い権利が保証されており、"Fourth Amendment"として知られます。

捜査令状無く被疑者の扱いをして捜査を行うことは違憲とされており、過去には駐車違反取り締まりの目的でタイヤにチョークでマーキングをする手法が違憲との裁判所判断が出たくらいです。カメラの映像を利用して行動把握したり、不法移民の摘発を行うなどの行為は"unreasonable search and seizure"とされるのもやむなしといったところでしょうか。

Memorundum of Understanding

アメリカとイランが戦闘終結でようやく合意に至ったと報じられました。

今朝の報道によれば、両国首脳が覚書に署名したということです。この「覚書」ですが、英語では、


Memorandum of Understanding 


と呼ばれ、MOUと略されます。

当初非公開であったこの覚書の14項目の合意事項は公開され、CNNの記事で全文を読むことができます。


The United States on Wednesday released the official text of the memorandum of understanding reached over the weekend with Iran.

A senior US administration official read out the 14-point document, which spells out provisions for reopening the Strait of Hormuz, easing certain financial restrictions on Iran and sets out expectations for addressing Iran’s nuclear program during future technical talks.

Titled the “Islamabad Memorandum of Understanding between the United States of America and the Islamic Republic of Iran,” the document was released after outcry that its text hadn’t been released publicly.

両国が戦闘行為を直ちに止めること、ホルムズ海峡の開放、イランの核開発の凍結などが合意されたということになっています。

しかしながら、この「覚書」を意味する"Memorandum of Understanding"の"memorundum"は法律用語で、


A short document outlining the terms of an agreement, especially as a draft leading to a formal, detailed contract: a memorandum of understanding.

と定義されており、正式、公式の契約合意に先立つ「ドラフト」(案)という意味合いがあるようです。

実際、覚書の第13項目では下記のようにあり、


13 — After signing this MOU, and subject to the beginning of the implementation of paragraphs 1, 4, 5, 10 and 11 of this MOU, and the continuing implementation of these measures, the United States of America and the Islamic Republic of Iran will start negotiations regarding the final deal exclusively on the other paragraphs.

この覚書の内容に沿って両国が最終的な交渉をスタートするというもので、まだまだ先は長いことを予測させる内容になっています。

一歩前進と言えば前進ですが、アメリカもまだ軍事攻撃の可能性に言及しており、イラン側もホルムズ海峡を通過する船舶への課金を諦めていない節があるようですから、覚書の合意など反故にされる前提なのではと思わされます。

eventual intent

ブラジルで廃墟の橋から飛び降りるrope-jumpingというスポーツ(?!)で女性が死亡するという痛ましい事故が起きたと報じられています。

安全を確保するためのロープが装着されなかったことが原因らしく、女性は橋の上から約40メートル下に投げ出されたということのようです。SNSなどで映像が共有、拡散されているということですから、益々悲劇的です。


A woman has died in what appears to be a tragic extreme sports accident in Brazil.

Three men have been arrested over the incident, in which instructors failed to attach a rope to her before helping her jump from a bridge in São Paulo state.

本来ならば、安全を確保するロープを装着するところ、このイベントの運営スタッフが3人も付き添いながらロープを付けずに橋から落下させたということで、殺人罪も視野に警察当局の捜査が行われているとのことです。

さて、記事では運営スタッフ3人について、


are culpable of homicide with eventual intent - when someone does not have the direct intention but assumes the risk of killing -


とあります。

ここで"eventual intent"とは法律用語で、いわゆる「未必の故意」と呼ばれる概念です。即ち、人を殺すという意図は無かったけれども、もしかしたら相手を殺してしまうことになるかも知れない、という自覚があったか否かが問われる事態となっています。"eventual"、"eventuality"といった単語は結果として起こる(事)という意味合いですが、偶発的な(事)、また不測の事態という意味合いがあります。

rope-jumpingというのはバンジージャンプ(bungee)とはまた異なるものらしいですが、こういった危険を伴うスポーツ(?!)での事故を聞くにつけ、やはり怖いもの見たさとしても避けたいところだと思います。(以前取り上げた、BASE jumpも参照ください。)

perjury

今月始めに国土安全保障省の長官から更迭されたKristi Noem氏に偽証罪の嫌疑がかけられています。

移民政策の一環で製作されたキャンペーン動画に200万ドルという巨費が注ぎ込まれたという件で追及を受けていたNoem氏は、費用についてトランプ大統領も了承の上だったと釈明しましたが、トランプ氏は聞いていないとコメント。Noem氏の釈明は議会での偽証に相当すると民主党が難じているものです。


The top Democrats on the House and Senate Judiciary committees are calling on Attorney General Pam Bondi to investigate whether departing Homeland Security Secretary Kristi Noem lied under oath before Congress.

偽証(罪)は英語で"perjury"といいます。この単語のスペル中に"jury"(陪審)という語を見ることができます。"jury"という単語は、誓約する、誓うという意味のラテン語iurareから来ています。

では、接頭辞にあたるper-は?

これまでも漠然と疑問に思っていました。よく知られる接頭辞per-の意味合いは、〜を通して、とか貫通して、というものですが、ここでの接頭辞per-には、除去、破壊、〜を害する(harmful)、という意味があります。

つまり、ウソはつきません、という宣誓を毀損する行為が偽証、ということになります。

接頭辞per-のちょっと変わった意味合いですが、実のところ、perish(朽ちる)、perfidy(裏切る)といった単語にも見られるものです。

force majeure

アメリカによるイランへの軍事攻撃は中東情勢を不安定なものにし、原油の輸出と価格に影響を及ぼしています。イランによる報復攻撃はクエートなど親米の産油国に及び、原油が輸出されるメインルートとなるホルムズ海峡が封鎖されるなどしているためです。

石油会社は生産を制限し、"force majeure"を宣言、とトップニュースで報じられています。


March 7 (Reuters) - Kuwait Petroleum Corporation began cutting oil output on Saturday and declared force majeure, adding to earlier oil and gas reductions from Iraq and Qatar as the U.S.-Iran war blocked shipments from the Middle East ​for the eighth consecutive day.

The war has blocked the world's most important oil ​artery the Strait of Hormuz which is responsible for 20% of ⁠global oil and LNG supply. Analysts predict the United Arab Emirates and Saudi Arabia will ​have to also cut output soon as they run out of oil storage.

"force majeure"とは聞き慣れない用語かと思います。字面からフランス語であると分かりますが、契約書などで使われる用語で、不可抗力(条項)と訳されます。

今般のイラン情勢に関連して"force majeure"を解説した記事から引用します。


Force majeure, a French term meaning “superior force,” is a clause included in many international commercial contracts. It allows companies to suspend contractual obligations when extraordinary events beyond their control, such as war, natural disasters or government actions, make it impossible to fulfill them.

"force majeure"、すなわち今回のように紛争の勃発や自然災害など、想定外の事態により契約義務を履行出来なくなった状況を指します。契約書において、そのような場合に義務を免除する条項を"force majeure"(不可抗力条項)と呼びます。

American Heritage Dictionaryでは、別名"vis major"というとあります。(visはラテン語で力を意味する名詞です。)

garnish

トランプ政権は、奨学金の返済滞納者に対して、給与を差し押さえる措置を2026年以降再開すると発表しました。


The Trump administration will resume garnishing wages from student loan borrowers in default in early 2026, the U.S. Education Department confirmed to NPR.

The move comes after a years-long pause in wage garnishment due to the pandemic.

"We expect the first notices to be sent to approximately 1,000 defaulted borrowers the week of January 7," a department spokesperson told NPR. The spokesperson said wage garnishment notices are expected to increase on a monthly basis throughout the year.

などというくだりがあり、"garnish"という単語が使われています。

「ガーニッシュ」と聞くとまずは食事に彩りを添えるための装飾(パセリとかクレソン)という意味を思い浮かべます。また、クルマ好きの人は、フロントやリア、サイドなど、外装に取り付ける装飾のことを思い出すのではないでしょうか。

"garnish"にはもちろんこれらの意味があるのですが、


債権を差し押さえる


という意味もあることは知りませんでした。

"garnishment"とは、


(債務を満足させるための)財産差し押さえの通知
(研究社新英和大辞典)


という意味の法律用語です。

"garnish"という単語はフランス語garnirから来ているそうですが、そのフランス語は装飾するという意味の他、通告する、召喚状を発するという意味があるということです。さらに遡るとゲルマン語系warnjanという語に辿るのですが、これは"warn"(警告する)という単語と同根であるということです。

料理やクルマの飾りとは一見相容れない法律用語としての意味は意外にも思われますが、語源では痕跡を残しているということかと思います。

小生も育英会の奨学金を借りておりました。(何とか返済し終えましたが・・・。)

料理の"garnish"は結構ですが、借金で"garnish"は避けたいところです。

presumption of innocence

アメリカの保守政治活動家のチャーリー・カーク氏がユタ州で演説中に銃で撃たれて暗殺された事件で、逮捕された容疑者の公判が始まるようです。

容疑者は出廷に際して、平服を着用することを要望し認められた、と報じられています。通常であれば、自殺を防止するジャケット、手錠や足枷などの拘束具が装着されるところ、拘束は最小限に留められ、また写真やビデオ撮影も禁じられるという、異例の対応です。


The man accused of killing right-wing activist Charlie Kirk will be allowed to wear civilian clothes during pre-trial hearings to avoid prejudicing potential jurors, a Utah judge has said.

Judge Tony Graf said Tyler Robinson will be required to wear restraints during hearings, but photo or video of him in restraints will be barred.

During a Monday court hearing, Judge Graf acknowledged massive interest in the case and urged that Robinson's "presumption of innocence remains".

"Balancing these factors, the court finds that Mr Robinson's right to the presumption of innocence outweighs the minimal inconvenience of permitting civilian attire," Judge Graf said, according to a local Fox News affiliate.

異例の対応の背景には、容疑者の権利擁護という判断がある模様です。

"presumption of innocence"という用語は「推定無罪」と訳されます。何人も有罪と裁定されるまでは無罪と推定されるという法の原則を指すもので、ユタ州判事の判断は、拘束されている容疑者のイメージは陪審員らの偏見を生むリスクがある、ということのようです。

カーク氏暗殺事件はアメリカ国内はもとより、世界中で衝撃をもたらしましたが、故に裁判の行方も注目されるところです。

ちなみにユタ州は薬物注射に代えて銃殺による死刑を執行する数少ない州のひとつで、カーク氏暗殺の容疑者も有罪となれば死刑は免れないということです。

circumvent

ウクライナとロシアの停戦を仲立ちしている米国ですが、かねて報道されているようにトランプ政権のロシア寄りの姿勢が目立っています。

以下引用する記事ではロシアに対する経済制裁などの監視に米国があまり積極的に関わっていないと報じられています。


European officials have said that the Donald Trump administration has reduced its involvement in efforts to close loopholes for circumventing sanctions on Russia.

Details: The officials, who asked not to be named, said the United States was practically absent from several working groups set up by allies to combat attempts to circumvent sanctions imposed on the Kremlin.

経済制裁とは言っても様々な抜け穴(loophole)が存在するようです。

法や規制の「抜け穴」を見つけることを表現する動詞に、


circumvent


があります。

"circumvent"という単語は、周囲を意味する接頭辞circum-と、ラテン語venire(英単語のcome、goに相当)からなる単語です。

元々は、周囲を取り巻くという意味で、ラテン語の動詞circumvenioは敵を包囲するという意味です。

その後、対象を回避する(get around)、また回避することで問題を切り抜けるという意味で使われるようになりました。

今日では法や規制の抜け穴を見つけて義務を回避するという意味合いで使われる方が多くなっています。

日本語で「潜脱」という言葉があることを知りました。法律などを自己に都合の良いように解釈し、法の網を「潜る」という意味です。

de minimis

トランプ大統領による貿易相手国への関税引き上げが次々と発動されています。

その一環で、これまで非課税であった少額の輸入品へも課税することになったと報じられています。


President Donald Trump will close a loophole that allows online retailers to send small packages to the U.S. without paying a tax as part of his trade tariffs clampdown - a move that could have an impact on the wallet of everyday Americans.

Under the “de minimis” exemption, a longstanding rule that applies to packages entering the U.S. worth under $800, retailers overseas are allowed to sell products at lower prices by shipping them straight to consumers, bypassing domestic warehouses.

The loophole is commonly used by online Chinese retail giants such as Shein and Temu. It has allowed the brands to sell goods at extremely cheap prices and seen their popularity grow in recent years.

"de minimis"と呼ばれる例外ルールの下、800米ドル以下の輸入品はこれまで非課税でしたが、この例外を無くすというものです。

"de minimis"はラテン語です。

ラテン語minimisは、スペルから想像が付くと思いますが、最小という意味で、deは英語ではof、あるいはaboutに相当する前置詞ですから、"de minimis"の意味するところは、最小のものについて、ということになります。

Merriam-Webster Dictionaryによると、この"de minimis"という表現は実のところ、以下のラテン文、


de minimis non curat lex 


に由来しており、その意味は英文では、


"the law does not concern itself with trifling matters"


となります。

つまり、最小(些少)のものに対しては気にしない(敢えて取り沙汰すことはしない)、という意味です。

法律のコンテクストから生じた表現ですが、貿易関係や経済の用語として用いられることの多い表現のようです。カタカナで、「デ・ミニミス」(また、デ・ミニマス)規定などと書かれることもあります。

habeas corpus

「象は人間ではない、米司法判断」(Elephants are not people, US court rules.)との見出しが目を引きました。

何の話かと思いきや、米・コロラド州の動物園に対して、象を解放せよ、自然に帰せ、との訴えが動物愛護団体から提起されたというのです。


A bid to free five elephants from a Colorado zoo has been rejected after a court ruled elephants are not people.

An animal rights group argued Missy, Kimba, Lucky, LouLou and Jambo were effectively imprisoned at the zoo, and had filed to have them moved to an elephant sanctuary.

It tried to bring a habeas corpus claim on behalf of the animals - a legal process which allows a person to challenge their detention in court.

The Colorado Supreme Court said the matter boiled down to "whether an elephant is a person" and therefore had the same liberty rights as a human - ultimately deciding that they did not.

訴えは却下され、その理由が「象は人間ではないから」、というものだったということなのですが、動物愛護団体が持ち出してきたのは、


habeas corpus claim


というものだったとあります。

"habeas corpus"とは、人身保護令状、身柄提出令状などと訳される法律用語で、ラテン語です。

英訳すると、"(you shall) have the body"、和訳としては、「身柄を差し出すべし」、という命令文となります。

違法な拘禁を防ぐために被拘禁者の出廷を命命令する令状(ランダムハウス英和辞書)という説明が添えられており、要は不当に拘禁されている人を保護するためのものです。

動物愛護団体は、動物園の檻に「不当に拘禁」された象を憐んでその解放を"habeas corpus"でもって実現しようとしたのでしょう。

裁判所は「象は人ではないから」、「人身」保護令状の適用対象には当たらない、と訴えを斥けた、ということです。

heir apparent

クルマを運転しながら正午のNHKニュースに耳を傾けていると、ウィスコンシン州で共和党の党大会が開催され、トランプ元大統領が党の大統領選挙候補者の正式指名を受けたと伝えていました。先週の発生した銃撃事件の衝撃冷めやらぬ中、トランプ候補の勢いは増す一方のようです。

一方のバイデン大統領と言えば、6月末の討論会での衰えぶりから撤退を要求する声が民主党内からも噴出するなど、苦しい状況に置かれています。そして、追い打ちをかけるように、新型コロナに感染・・・。頑なに続投を表明していたバイデン氏ですが、ここ数日は言動に変化が見られるとの報道も見られます。

夕方、ニュースを斜め読みしていますと、バイデン氏が撤退表明をするのは時間の問題と見られているようです。

バイデン氏が撤退したとしたら、民主党の候補者はどうなるのか?誰もが思うところでしょう。

引用した記事によれば、バイデン氏の後を継ぐのは副大統領のカマラ・ハリス氏との見方が有力のようです。

記事のタイトルでは


Harris is considered heir apparent


とあります。

"heir apparent"とは、法定(推定)相続人、という訳語がついていますが、被相続人が死亡した場合に当然法定相続人となる人、という説明がされています。(研究社新英和大辞典)

法定相続人という言葉は難解な法律用語の響きがありますが、"heir apparent"には、


(地位・役割などを)継ぐことが確定的な人


という意味があり、引用した記事で使われている意味合いはこちらの方かと思われます。

この"heir apparent"に対して、"heir presumptive"という言葉もあるのですが、こちらは推定相続人という訳語になっており、その人より先順位の人が被相続人の死亡の前に出現すれば相続権はない、との解説があります。

アメリカにおける副大統領は、大統領にもしものことがあった場合には直ちに大統領職を執行する立場にあると聞きます。副大統領に優先する立場の人はいない訳で、そういうことからバイデン氏が大統領選から撤退するということになれば、当然ながら副大統領が代わって候補者となる、ということなのでしょう。

hung jury

ポルノ女優との不倫揉み消し疑惑で訴追されているトランプ元大統領に対する裁判がニューヨークで行われていますが、審理は最終局面にあり、火曜日に最終弁論の後、陪審員による審議に入るとのことです。

米史上初となる大統領経験者への裁判の判決がどうなるのか、注目されていることは言うまでもありません。

今回、トランプ氏は34の罪状で起訴されていますが、陪審による評決のシナリオには4つの可能性があるそうです。

有罪、無罪の2つはすぐに思い浮かべるところです。

3つ目は34の罪状のうち、一部有罪、一部無罪、というものです。

そして4つ目ですが、


hung jury


と呼ばれる可能性だそうです。

この"hung jury"という言葉を初めて聞きましたが、日本語では評決不能陪審、不一致陪審といった日本語訳が当てられています。別名"deadlock jury"ともいうようです。

アメリカの裁判では12人の陪審員が判決を評議しますが、最終決定は全員一致が原則で、1人でも異なる意見があると、それは"hung jury"ということで、裁判不成立となってしまうのだそうです。

裁判長は"hung jury"に対して改めて意見の一致を見出すよう差し戻すこともあるそうですが、陪審員の少数派に働きかけることは陪審制度を歪める恐れもあることから、陪審の決定は尊重されるべきものです。

alibi

アイダホ州で大学生ら4人が殺害された事件の容疑者の審理を報じる記事を読みました。

4人の殺人容疑で逮捕されたBryn Kohberger容疑者の弁護側は、事件発生時刻とされる2022年11月13日午前4時過ぎ、容疑者は事件現場から遠く離れた場所に居たため、事件への関与は無いと主張しているようです。

いわゆるアリバイがある、というやつです。

容疑者は深夜ドライブや早朝にかけてのハイキングを趣味にしていたといい、当日も現場から30マイル以上離れた公園にいたと主張しています。


Lawyers representing Bryan Kohberger, the suspect in the killing of four University of Idaho students, plan to call in an expert on cellphone tower data to bolster his claim of being far away from the scene of the crime when the victims were stabbed to death in November 2022, according to a court document filed by the defense.

Kohberger’s attorneys beat a Wednesday deadline with an alibi defense filing that provided details of their client’s purported whereabouts at the time of the homicides, as required by Idaho law. Kohberger, 29, is facing quadruple-murder charges.

刑事ドラマなどでもお馴染みのこの「アリバイ」は法律用語で現場不在証明と訳されたりもしますが、ラテン語です。

ラテン語の辞書にもalibiというスペルで載っています。「アリバイ」は英語の発音です(「ア」に強勢が置かれます)が、ラテン語はローマ字読みしますので、その発音は「アリビー」のようになります。

ラテン語alibiの品詞は副詞であり、他の所で(また、他の点で、他の人によって)というような意味ですが、ラテン語alius(英単語のanotherに相当)とibi(英単語のthereに相当)が組み合わさったものです。

carveout

フロリダ州で16歳以下の子供がSNSアカウントを持つ事を禁止する新法が可決されました。画期的な法制化だと思います。

デサンティス知事肝入りの政策のようですが、米国ではSNSの過剰な利用が原因で精神を病んだり、自殺する子供の数が増えていることなどが社会問題になっています。SNSでのやり取りを通じて未成年者を狙う犯罪も後を絶ちません。

来年2025年1月から施行されるという法律では、14歳未満のSNSアカウントは禁止され、15〜16歳では親の同意が必要になるとのことです。


Florida Gov. Ron DeSantis approved legislation Monday prohibiting minors under the age of 14 from using social media and mandating 14-and-15-year-olds obtain parental consent before logging on. 

The new law, House Bill 3, compels social media firms to scrap existing accounts for children and permits parents to request their child’s account be terminated.

特定のSNSを名指ししたものではないようですが、フェースブックやツイッターなどの大手は対応が求められるのは必至で、16歳以下の既存アカウントは停止しなければならないということになっています。

ところで、

というくだりがあるのですが、ここでの"carveout"の意味が分かりませんでした。

実際のところ、辞書にも意味を載せているものが見当たらないのですが、他メディアの記事なども参照してみたところ、ここでの"carveout"は、


例外(exemption)


という意味で用いられてられいると分かりました。

"carve"には切り分ける、刻むという意味があります。故に経営の用語として、事業の切り出し(事業分割)という意味でも用いられるそうですが、法律のコンテクストでは法文、規定の内容における例外を指すのに用いられるようです。これもある意味、分ける(分けて考える)という事かと思います。

ということで、今回のフロリダ州の新法はSNSアカウントは禁止、但しメールやメッセージングアプリは例外的に許容される、ということになります。

米国の他の州が追随するのか、また他国や日本はどう対応するのか、個人的に関心があるところです。

welfare check

航空機製造大手のボーイング社の杜撰な品質管理を内部告発した男性が不審死を遂げるという事件が大きく報じられています。


A former longtime Boeing employee who had raised serious concerns about the company’s production standards was found dead in Charleston, South Carolina, over the weekend, according to the Charleston County Coroner’s Office.

A news release from the Charleston County Coroner’s Office said John Barnett, 62, died on March 9, from “what appears to be a self-inflicted gunshot wound.” The city’s police department says detectives are investigating the case and “awaiting the formal cause of death, along with any additional findings that might shed further light on the circumstances surrounding the death of Mr. Barnett.”

ボーイング社の品質管理部門で30年以上に渡る勤務した男性は近く証言台に立つ予定だったそうですが、駐車場の車の中で死亡しているのが発見されたということです。拳銃による自殺と見られるということですが、その理由が見当たらず、当然怪しいということになります。

男性の死亡が確認されるに至った経緯について、以下のくだりがあります。

When they arrived, responding officers found Barnett in the driver’s seat of a truck in the parking lot, with a gunshot wound to the head. He was holding a handgun. ここで引っ掛かったのが、


welfare check


という言葉です。

"welfare"という単語を福祉、厚生といった日本語で暗記しています。この日本語が邪魔をするのか、どうもコンテクストに照らしてしっくりと来ません。また、この"welfare check"なる表現は英和辞書に載っていないようです。

ここでは、"welfare check"を警察が行なった(conduct)、とあります。"dispatched"ともありますから、警察は要請を受けて"welfare check"のために男性の元に駆けつけ、その死亡を確認するに至った、と解釈することができます。

そうすると、"welfare check"に意味するところはいわゆる安否確認、生存確認のことであろうと思われます。

ネットを検索してみると、"welfare check"は"wellness check"とも言うらしく、


A welfare check, also known as a wellness check, is when police stop by a person’s home to make sure they are okay. Requests for welfare checks are made by friends, family, and neighbors, typically after someone unexpectedly stops answer their phone or getting in touch with others.

との解説があり、やはり動静が不安視される人の安否確認を意味するようです。

報道によれば、"Rob"という人物から、男性の"welfare check"を要請する電話が警察にあった、ということで、男性の安否を気にかけていた人がいたことが分かっています。

John Doe

未成年者買春斡旋の罪などで有罪となり、その後獄中で不審死を遂げたJeffrey Epstein氏と親交のあった関係者の氏名が公表されることになったと報道されています。

同氏は政界、財界の有力者(はたまた英王室)と親交があったとされ、これらの関係者が未成年者買春を行なっていたのではないかとの一大スキャンダルとなったものですが、約5年の歳月を経てまた一騒動ありそうです。


A U.S. court is expected on Wednesday to start revealing the names of dozens of people with ties to deceased financier Jeffrey Epstein, a move that could unveil new details about his sex trafficking.

Epstein socialized with Wall Street titans, royalty and celebrities before pleading guilty to soliciting prostitution from a minor in 2008. He took his own life in 2019 at age 66 while awaiting trial on federal sex-trafficking charges.

公判記録などにおけるこれら関係者の氏名はこれまで公表されることはありませんでしたが、裁判所の命令により氏名が明らかになる模様です。

英語では氏名不詳者や敢えて氏名を明かさない場合に、


John Doe


という架空名をよく使います。"John Doe"は架空の男性名で日本語にすると某氏というくらいになります。女性の場合は、"Jane Doe"です。

今回明らかになる関係者は、Epstein氏の斡旋買春の顧客であった可能性がある訳ですが、「買春顧客リスト」とも言えます。ある記事の見出しでは、"John Doe list"と表現されています。

ありふれた、平凡(一般的)な英語名は、男性はJohn、女性はJane、というのがほぼ定着していると言えますが、この"John Doe"というのは元々はイギリスの法律用語で不動産回復訴訟において原告を仮想的に呼んだもの(研究社新英和大辞典)、だそうです。

因みに、"Richard Roe"(女性形はJane Roe)という表現もあり、こちらは同じく訴訟における被告を仮想的に呼ぶものだそうなのですが、これは知りませんでした。

恐らく"Richard Roe"よりも、"John Doe"の方が馴染みがあるのではないでしょうか。

2020年大統領選の結果を覆そうとした罪などでトランプ元大統領が訴追されていますが、トランプ氏側の弁護団は、裁判に携わる判事が適任ではないと主張している模様です。

当該判事がトランプ氏に対してかねてより批判のコメントをしていることなどから、不公平であると主張、判事は裁判に関与すべきで無いと要求しているものですが、この件に関する記事で、


recuse


という見慣れない単語が使われています。

記事のタイトル、及び本文中、

とある部分がその箇所となりますが、"recuse"という単語を見るのは初めてのように思います。

そのスペルは"refuse"、あるいは"accuse"にも似ているように見えるので意味するところを想像することが出来ますが、実際関連があるといえばあるようです。

"recuse"という単語は法律用語であり、裁判官や陪審員という役目を忌避する、というものです。これは今回トランプ氏側弁護団が主張するように、裁く側と裁かれる側との関係に利益相反などの状況があるために審理に携わることが不適当と看做される場合に、その役目から退くということを意味します。ある意味、"refuse"に置き換えるとして、当たらずとも遠からずというところでしょう。

"recuse"の語源ですが、接頭辞re-と、ラテン語causa(訴訟)から成ります。"accuse"は非難するという意味ですが、こちらも接頭辞ad-にラテン語causaが結合したものなので、同語源です。

certiorari

2020年にミネソタ州でGeorge Floydさんが警官に拘束され死亡しました。Floydさんの首を脚膝で押さえ付けて窒息死させた警官は殺人罪などに問われ有罪となり、Black Lives Matter運動を全米、また世界的に引き起こすきっかけとなったものです。

22年と6ヶ月の実刑が確定したDerek Chauvin被告の弁護士は再審を求めて上訴するようです。

CNNの記事から引用です。


Derek Chauvin, the man who killed George Floyd, will take the appeal of his state murder conviction to the Supreme Court after Minnesota’s top court denied the request to hear his petition.

“We will petition the United States Supreme Court via a Writ of Certiorari and ask them to review the lower court’s decision on behalf of Mr. Chauvin,” attorney Gregory M. Erickson said in a statement Wednesday.

Chauvin被告の弁護士はミネソタ州裁判所が被告による請願を棄却したことなどを不服として最高裁に上訴するということのようですが、記事中、

という言葉が出てきます。

"Writ of Certiorari"とはなんぞや?ということなのですが、いかにも法律用語、またラテン語という感じがします。

"writ"は命令(書)のことで、"certiorari"とは事件(書類)移送命令書、という意味で、上級裁判所が下級裁判所に命じるものなんだそうです。(研究社新英和大辞典)

"certiorari"はやはりラテン語で、意味的には"to be informed"という説明が見えます。

ラテン語のスペルからは英単語の"certain"、あるいは"certify"が見てとれますね。

米国の裁判や法律について詳しいことは分かりませんが、"certiorari"においては上級裁判所(ここでは最高裁)がその裁量により下級審の見直しをするということのようです。

grievous bodily harm

オーストラリアで、95歳女性が警官にテーザー銃を使われてその後死亡したという事件で、女性の遺族が州政府を相手取って訴えを起こしました。

女性は認知症を患っていましたが、介護施設でナイフを持っていたところを警官がテーザー銃を使って制止しようとした模様です。女性は転倒して頭を強く打ち、1週間後に死亡したというものです。

この件は5月のニュースで読んだので記憶に残っています。

訴えられている警官が問われているのは、95歳という高齢に加えて歩行器に掴まるか弱い老女にテーザー銃を使うことの正当性というところでしょうか。

女性は転倒し、頭を強く打った結果亡くなりましたが、記事では、


grievous bodily harm


という表現が使われています。

ちょっと変わった言い回しだなぁと思って辞書を引いてみると、実は立派な法律用語なのでした。

研究社新英和大辞典では「重傷」、「重大な身体傷害」という訳語になっています。また、手元にOxford Dictionary of Lawがあるのですが、"grievous bodily harm"は略してGBHとも言うそうです。

"grievous bodily harm"のgrievousは"grieve"という単語、またgrieveは"grief"(不幸、不運、またそれらによってもたらされる悲嘆、悲しみ)と関連があります。いずれも、ラテン語gravis(重い)から来ています。
