Eighth Amendment

テネシー州で31年前の殺人事件の被告として死刑判決を受けていた女性の死刑が執行されましたが、薬物投与による死刑執行が失敗したとのニュースを読みました。女性は1週間ほど意識不明の状態が続き生命が危ぶまれていましたが、その後意識を回復し会話ができるようにまでなったと報じられています。こうした事例は前代未聞です。


NASHVILLE, Tenn. (WSMV) - Christa Pike is “conscious, speaking, and continues to receive critical medical care” nearly a week after her botched execution, her attorneys said on Tuesday.

Pike, who is convicted for the 1995 torture and murder of Colleen Slemmer, was supposed to be executed via lethal injection in Tennessee last Wednesday. However, after receiving two doses of what should have been lethal amounts of pentobarbital, she survived.

Whether the state can proceed with another execution attempt remains to be seen.

“Given what we know now, how she responds to lethal injection, and given what happened to her, Christa Pike’s lawyers have a pretty good argument that it would be a violation of the Eighth Amendment to execute her using [lethal injection],” Vanderbilt Law School professor Christopher Slobogin told WSMV4.

失敗した死刑執行は再開されるのか?つまり2回目の死刑執行を行うことは許容されるのか、という問いが持ち上がっています。

これに対しては、被告の弁護士は再度の死刑執行は残酷であり、終身刑への減刑が妥当だとの主張をしていると別記事でも報じられています。

"Eighth Amendment"、これは合衆国憲法修正第8条というものですが、過剰な処罰、特に死刑に関しては残酷な刑を禁じています。"Eighth Amendment"の内容は以下のようなものです。


Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
