A creepy Atlanta-area school bus driver is reportedly out on bond after he allegedly broke into the home of a 10-year-old girl looking for her on Monday.

Gogineni Rayudu, 56, was arrested Tuesday and charged with felony burglary and misdemeanor loitering but was already back on the streets on Thursday after posting a $20,000 bond, The Atlanta Journal-Constitution reported.

The turnstile justice left the young girl’s distraught mom, Cassie Cea, “in shock.” To protect her family she has since obtained a restraining order against Rayudu, the report said.

“I’m just really freaked out,” Cea told the newspaper on Friday. “He was definitely up to something bad — I just don’t know how bad it was.”

内容は大体お分かりいただけるかと思いますが、第3段落目のところで、


The turnstile justice left the young girl’s distraught mom, Cassie Cea, “in shock.”


というくだりがあります。この"turnstile justice"という表現が何を意味するのか、考えてみたいと思います。

"turnstile"とは、回転木戸、回り木戸、などと辞書に載っていますが、いわゆるゲートのことで、十文字の回転するバーがあって一人ずつしか通過できないようにしているものです。回転式改札口などとも訳されていますが、日本の電車の改札ではあまり見かけませんけれども、入場を制限する施設の入口などで見かけることがあるでしょう。チケットなどを通すとバーが回転することで一人が中に入ることができるという仕掛けです。

この"turnstile"と"justice"(司法)という単語がひとつになって"turnstile justice"ということですが、何を言わんとしているのでしょうか。

記事の内容は、犯罪者が逮捕されながらも保釈金を払って自由の身となり、再び悪いことに手を染めようとしているという話です。"turnstile justice"はそういったことを指しているようですが、何と訳すのが適当か、という疑問が。

もう少し、理解を深めるべく、"turnstile justice"という言葉が使われているコンテクストを探してみます。あまり多くはないのですが、いくつかヒントになると思われる内容の記事をピックアップしてみました。

10年以上前の記事ですが、タイトルで使われている"turnstile justice"は、警官を殺害した犯人を釈放する判断を下した裁判官への批判として用いられています。

先の記事の例と併せて、"turnstile justice"には犯罪者に対する不十分な措置、つまり更生もしていないのに再び世の中に出て再犯に至るといった状況、またはそのような状態を許容している司法システム、といったことを指しているように思われます。

ところで、もうひとつ、また別の記事では、少し違った印象を与えられます。


NEW YORK, N.Y. – Fare beaters who hopped over grimy subway turnstiles back in the early 1990s were the first targets of a policing strategy that went after the smallest offences and was credited with helping to drive crime down to record lows.

So now, a new policy to halt the prosecution of turnstile jumpers in Manhattan has some city officials and riders questioning it as a foolhardy turning back of the clock.

ここで出てくる"turnstile"は文字通りの回転式改札口のことで、ニューヨーク地下鉄で導入されているものですが、その改札を飛び越え(乗り越え)て運賃を免れる悪い輩を、


turnstile jumpers


と呼んでいます。

このような不正乗車は90年代には警察の摘発の対象であったものが、(記事の書かれた)2018年には摘発しなくなった、というのが記事の趣旨で、そのことを"turnstile justice"と言っているようです。

不正乗車自体は犯罪のうちでも軽微なものに分類されるものでしょうが、そうした軽微な犯罪こそをきちんと取り締まってきたところが、軽微だからという理由で(?)取り締まらなくなった、というところでしょうか。

こうしてみてくると、"turnstile justice"の意味するところは、犯した罪の大きさにも関わらず、回転式改札を飛び越えて運賃逃れをする軽犯罪者を見逃すかのように社会に戻してしまうという歪んだ司法、というような意味合いに思われます。あるいは、地下鉄改札の"turnstile"のようにいとも簡単に乗り越えられてしまうようなお粗末な司法制度、というような意味合いでしょうか。

うまく訳せませんが・・・。
