時効 ー statute of limitations

いわゆる時効のことを英語で、

statute of limitations

と言います。

法律の専門家ではありませんので厳密、正確な説明をすることはできませんが、一定期間が経過すると罪や法令違反に問えなくなってしまうことを制度化したものが時効です。

米ABCテレビで起きたセクハラ事件の審理で、時効が認められて、訴えが破棄されたという記事からの引用です。

A New York State judge on Wednesday dismissed a lawsuit filed last year against Michael Corn, the former "Good Morning America" boss who was accused of sexual assault in a case that rocked ABC News and left staffers up in arms.

Judge Barbara Jaffe ruled that the statute of limitations for the alleged 2015 assault against "Good Morning America" producer Kirstyn Crawford had expired.

The alleged assault, which Corn had always denied, could have been considered by the court had Crawford sufficiently alleged that Corn created a hostile work environment.

"statute of limitations"を辞書で引くと、出訴期限法と載っています。法律の名称のようにも見えるのですが、記事ではいわゆる時効という概念を示す言葉として用いているようで、

the statute of limitations… had expired

というように用いられています。

また同記事の後半では下記のようなくだりがあります。

But Jaffe ruled that while some of Corn's alleged conduct was "boorish, ill-advised, and inappropriate," it did not meet the threshold to state a claim that he had fostered a hostile work environment prior to the limitations period expiring.

ここでは単に"limitations (period)"なんですが、やはり時効のことを指していると思われます。

手元にあるOxfor Dictionary of Lawsでは、"limitation of actions"という用語が掲載されており、以下のように定義されています。

Statutory rules limiting the time within which civil actions can be brought. 

昔読んだ本で時効の概念について説明したものがあり、記憶では権利行使に期限を定めるのが時効の考え方であるというものがありました。例えば、お金を借りた人が、時効を理由に金を返済しないでも咎められないという時効の制度は理不尽なようではあるけれども、お金を貸した人が返済を要求する権利を行使せず、「権利の上にあぐらをかく」ような姿勢を認めない仕組みが時効である、というような内容だったと記憶します。

セクハラ事件の詳細は知りませんが、時間を置かず訴えるべきだったのかも知れません。

balaclava

今日の1語、balaclavaとは何のことかご存知でしょうか？

答えは、目出し帽のことです。顔面をすっぽりと覆うようにして、目の部分だけが開いているものです。

Dozens of masked men, suspected of being tied to a White nationalist group, were arrested near an Idaho pride event on Saturday after they were found packed in the back of a U-Haul truck.

Couer d'Alene police confirmed in a press briefing that 31 individuals from a variety of states were inside the U-Haul after it was stopped by local and Idaho State Police several blocks from the pride event on Saturday afternoon. 

The several dozen men inside the truck wore khakis, navy blue shirts and beige hats with white balaclavas covering their faces and police say that some of them wore patches that identified with Patriot Front, a White supremacist group, according to some civil rights organizations.

以前、"half-masking"という表現を取り上げたことがありましたが、その際、"half mask"は目出し帽のように顔を覆う被り物のことだと触れました。

この"balaclava"は登山者などが防寒のために着用する毛糸の帽子、ニット帽のことであるという説明もあります。

ところで、"balaclava"の名前はウクライナのクリミア半島にある地名Balaklavaに由来します。

Merriam-Websterによると、クリミア戦争で英軍が使用したのが最初だそうです。

A balaclava is a knit cap used for protection against the cold that covers the head, neck, and most of the face. It is sometimes worn as a mask by criminals and terrorists.

The name comes from the site of a Crimean War battle in 1854, where the British army reportedly first used these caps.

時節柄、興味深い語源ではないでしょうか。

バリデーション？ ー validation

情報システムの仕事をしている人が「バリデーション」と聞いてまず思い浮かべるのは、コンピュータシステムのバリデーション（機能動作検証作業）ではないでしょうか。

私も多少関わった経験から、そんな刷り込みにも似た認識が出来上がってしまっています。

そういう訳ですので、以下に引用する記事で用いられている、

male validation

という表現には戸惑いを覚えたというのが正直なところです。

A Stanford professor has been criticized for writing 'offensive and disparaging' tweets describing female attorneys who represent men accused of assault as 'skirts' who are 'desperate to prove they are real lawyers'.   

Michele Dauber, who is based in California, criticized a number of lawyers including Camille Vasquez, who played a key role in Johnny Depp's recent defamation case against his ex-wife Amber Heard.

Following the case, in which a which a jury in Virginia found Ms Heard liable for three counts of defamation against Mr Depp, and him liable for one count against her, Ms Vasquez shot to international prominence.

While much of the attention given to the lawyer has been positive, she has also faced some negativity, including the tweets by Michele Dauber, which described the attorney as a 'pick me girl' - a phrase normally used to refer to women who crave male validation.

またまたジョニー・デップさんと元妻ハードさんのスキャンダルの記事で恐縮ですが、関心は英語表現ですので悪しからず。

元夫婦間の名誉毀損を巡る裁判はデップさん側の勝訴で幕を閉じましたが、デップさん側の弁護を担当した女性に対して、人格を否定するような批判がされている、というものです。

批判の発言の内容というのは、引用の最後にでてくるのですが、

というもので、ここに"male validation"とあるのを取り上げたいと思います。

上述しましたように、"validation"と聞くとコンピュータシステムのことを想起してしまうのですが、"validate"という動詞の意味には、

to recognize, establish, or illustrate the worthiness or legitimacy of

(Merriam-Webster Dictionary)

という定義があり、コンピュータシステムに限らず、物事の価値や正当性などを認めることを表現するのに用いられます。

ただ、"male validation"という言葉の意味合いを理解するのには、これでもまだ少しぼんやりとしているように思われます。

Merriam-Websterではさらに、"self-validation"という表現を取り上げており、以下のように定義しています。

the feeling of having recognized, confirmed, or established one's own worthiness or legitimacy

この定義を読んでピンと来たのですが、"self-validation"とは自分自身の価値が認められたという気持ちのこと、つまり承認欲求が満たされた状態のことを指すと分かります。

"male validation"については辞書に載ってはいませんが、"self-validation"という表現の延長と考えるならば、自らの価値を男性に認めてもらいたいという（女性の）気持ち、欲求、ということになるでしょう。

Latinx

最近ラテン語の勉強を再開しました。あらゆる品詞が複雑に格変化することは元より、名詞の性（男性、女性、中性）を覚えなくてはならないのが大変です。

初歩の教科書では、語尾が-aで終わる第一変化名詞からスタートしますが、例外を除いては女性名詞である、と解説されています。

そんな勉強をしているので、同じくラテン語系の言語であるスペイン語においても、名詞に同じような性質があることは理解できます。

ところが、最近、"Latinx"という単語が取り沙汰されているということを知りました。主に書き言葉で使われるようですが、発音は語尾の-xを「エクス」と発音し、敢えてカタカナにすれば「ラティネクス」のようになるそうです。

"Latinx"というのは、"Latino"でもなく、また"Latina"でもない、つまり男性、女性を区別しない、故に差別的でない表現なのだということらしいです。

Far-left Rep. Alexandria Ocasio-Cortez defended using the word “Latinx” to describe Hispanic men and women over the weekend and slammed her Democratic colleagues who she said “rail against” it — despite polling data indicating most Hispanics don’t use the term or virulently object to it.

"Latinx"と表現する他、"Latine"という言い方も同様です。

スペイン語の名詞において、語尾が-oとなるのは男性、-aは女性という規則性があるところ、これらの語尾を-x、もしくは-eで置き換えたのが"Latinx"であり、"Latine"ということなのです。

Ocasio-Cortez went on to claim that while “Latinx” is more convenient in written form, another gender-neutral term, “Latine,” is a better alternative when speaking. She also suggested both terms are comparable to the Spanish word “nosotres,” which translates to a gender-neutral “us” or “we.”

多様な性自認に寛容であろうとする現代において、言語や言葉遣いに性差別的なものを見ようとする動きが顕著になっています。

一方で、こういう傾向に異を唱える人もいます。

"Latinx"という言葉について、そもそもスペイン語を母語とする当事者が好ましいとは思っておらず、性自認に寛容であろうとする一部の活動家などが推進しているに過ぎない、という意見です。

It soon became clear it was no joke. Latinx was becoming an official term on elite college campuses, popular among academics, progressives, young activists and LGBTQ groups who wanted gender-neutral terminology. (In Spanish words ending in “O” are masculine and those ending in “a” are feminine. When referring to a mixed-gender group, the plural word ends in the masculine “O,” so substituting that letter for “X” avoids preferencing the men.)

性自認に寛容であることは決して悪いこととは思わないものの、行き過ぎると言葉狩りのようにも感じられるということでしょう。

外国語の文法の教科書は書き換えを迫られるのでしょうか。

「〜はマスト」 ー de rigueur

パンデミックにより一部の労働者においては定着した感のあるリモートワークですが、オフィス回帰を促す経営層との意識差については先日の投稿でも見てきた通りです。

労使間関係のダイナミズムはマーケットの状況、即ち市場に人材が溢れているのか、それとも足らないのかに左右されるものですが、今日ではどちらかと言えば企業が必要とする人材が不足している傾向のようです。従って、経営側は労働者確保のためには、リモートワークというオプションはある意味必須条件ともなりつつある、というのが以下に引用する記事の主旨です。

However flawed, remote work arrangements have become a linchpin of a COVID-era labor market defined by high employee turnover.

For many knowledge workers in an economy with more open jobs than workers to fill them, WFH is more de rigueur than ever before.

Even when they've done it unenthusiastically, more employers have embraced flexible work-from-home arrangements.

という部分に着目しましょう。

イタリックにしましたが、最初読んだ時はすんなりと頭に入って来ず、スペルミスかと思いました。

この表現を知りませんでしたが、"de rigueur"でひとかたまり、よく見ればフランス語のスペルのようです。

実際、"de rigueur"はフランス語であり、"rigueur"は英単語では"rigor"に相当します。

お手持ちの辞書にもきっと載っていると思いますが、意味は、

礼式上必要である

というもので、この表現が用いられるのは主としてドレスコードなどを記載する場合です。

それは例えば、会食等において出席者はスーツ、ネクタイ着用が必須、といった具合のドレスコードのことであり、フランス語では"costume de rigueur"と呼ばれます。

この"de rigueur"という表現がフランス語のスペルそのままで英語に入ってきたようですが、上記の引用例に見られるように、コンテクストはドレスコードに限らず、現代風に言えば、「〜はマスト」（必須である）という時のフレーズとして広く用いられるようになりました。

コーパスでいくつか用例を拾ってみました。

Suits are back, hemlines are longer, button-down shirts are de rigueur.

スペルのみならず、発音がややこしそうです。rigueurに見られるフランス語特有のスペル、-eurはamateurやentrepreneurといった単語にも見られるものです。

実際、これらの単語もそのまま英単語になっていますから、"de rigueur"を会話の中で使ってみるというチャレンジをしても良いかも！？
